ALL USE OF POWWOW CLIENT SOFTWARE IS SUBJECT TO THIS LICENSE
AGREEMENT.  BY CLICKING ON THE “YES” BUTTON BELOW, YOU ARE
AGREEING TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS
AGREEMENT, AND YOU CONSENT TO BE BOUND BY AND BECOME A PARTY
TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL THE TERMS AND
CONDITIONS OF THIS AGREEMENT, CLICK THE “NO” BUTTON AND YOU
WILL NOT HAVE ANY LICENSE TO AND MAY NOT USE ANY PART OF THE
POWWOW SOFTWARE.  TRIBAL VOICE’S ACCEPTANCE IS EXPRESSLY
CONDITIONED UPON YOUR ASSENT TO ALL THE TERMS AND CONDITIONS
OF THIS AGREEMENT; IF THESE TERMS ARE CONSIDERED AN OFFER BY
TRIBAL VOICE, ACCEPTANCE IS EXPRESSLY LIMITED TO THESE TERMS.

PowWow copyright (C) 1995-2000 by Tribal Voice, Inc.  All
rights reserved.  PowWow is distributed free-of-charge for
personal non-institutional use by individuals.  Tribal Voice,
Inc. reserves the right to charge for all other uses.

GRANT

By using the PowWow Software (“PowWow”), you agree to
abide by the terms of this license agreement (“Agreement”).
Subject to the terms of this Agreement, Tribal Voice, Inc.
(“Tribal Voice”) hereby grants you a limited, personal,
nontransferable, nonsublicensable, royalty-free, nonexclusive
license to use one copy of PowWow in object code form only on a
single computer and only in accordance with the applicable end
user and technical documentation for the purpose of accessing
the Tribal Voice Registration Services in order to interact
with other PowWow users via the Internet.

Tribal Voice, Inc. provides a pleasant environment for all users of
its software, services, and related material to enjoy and will take
whatever actions are necessary to reach this goal.

Tribal Voice, Inc. cooperates fully with Internet service providers
and law enforcement agencies in reporting and investigating any
illicit activities.

We have established the following Terms and Conditions for use.  Please
read them carefully.

By using this software and services you agree to abide by the Terms and
Conditions.

TERMS AND CONDITIONS.

You agree to use Tribal Voice, Inc.’s products only for lawful
purposes, in compliance with all applicable laws.  You are prohibited
from using Tribal Voice, Inc.’s, products to compromise security or
tamper with resources of any computer systems.  You are solely
responsible for any content you transmit through or which make use of
Tribal Voice, Inc.’s products.

You agree to enter a valid email address, of which you are the owner or
primary user, and a unique password. If you use an address that is not
yours, we will not be able assist you with password problems, reply to
answering machine messages you may leave, and so forth.  In short, we
will not be able to communicate with you.  You are entirely responsible
for any breach of privacy or security resulting from your failure to
maintain the confidentiality of your password.

Tribal Voice also recommends that teenagers take steps to protect their
privacy and safety when using the PowWow service or any other public
forum.  Teenagers are advised not to supply detailed information about
themselves in communications with people they do not know.

Adults are encouraged, but not required, to use their real names, unless
you are using a service which requires or encourages anonymity.  You
may not use a name to intentionally impersonate someone or perform
fraudulent activity.  This includes, but is not limited to, the
substitution of letters or numbers, such as the number “1″ for the
lower-case letter “l” or the number “0″ for the upper-case letter
“O,” and so forth.  Vulgar or sexually explicit names are prohibited.

If Tribal Voice, Inc.’s products are used by persons other than
yourself on your computer, you are responsible for their actions.

You must behave in a responsible fashion.  You agree not to do
anything that detracts from other persons’ enjoyment of the Software
or services.

Tribal Voice, Inc., its suppliers, licensors, and affiliates reserve
the right to take lawful and reasonable actions against anyone who
violates these Terms and Conditions, including, but not limited to,
modifying or discontinuing your access to Tribal Voice, Inc.’s
products with or without notice to the User.

Tribal Voice, Inc. may, at its sole discretion, exercise its right to
modify or discontinue use of Tribal Voice, Inc.’s products, goods, or
services.

Tribal Voice, Inc., does not advocate censorship, but profanity used
for harassment or disruption is not a question of free speech.  Such
behavior is rude, abusive, and in some cases it is illegal.

The purpose of PowWow is the free exchange of ideas.  The unwelcome
use of profanity and sexually-suggestive comments, is prohibited on
PowWow.  Profanity, sexually-suggestive comments knowingly made to
minors, sexual harassment of a child, even verbally, is a serious crime
and subject to prosecution.  Do not send materials that contain viruses,
worms, or any other destructive elements.  Insults, threats, pyramid or
other soliciting schemes, or other unwelcome actions meant to disrupt or
abuse other PowWow users are also prohibited.

Tribal Voice allows users to run their own private Communities.  You
agree to adhere to the rules, regulations, policies, guidelines, and
any other such instructions of any Community you join, regardless of
where such information is posted.  Any and all Communities should be
regarded as privately-owned and administered/moderated as the owner
sees fit.  You agree to follow any instructions given by a Community’s
Administrator(s) and/or Moderator(s).  Abusive activity within a private
Community must be reported to the Community’s Owner, Administrator(s),
or Moderator(s).

Tribal Voice, Inc., disclaims any and all responsibility for actions
taken by users of our software and services.  You are solely responsible
for maintaining the security of your computer and network connection.

Questions about the Guidelines should be addressed to policy@tribal.com.
Reports of violations should be addressed to abuse@tribal.com, with the
Connection Information of the abuser, the address of the Community in
which the abuse occurred, and any logs or screen captures.  Tribal
Voice, Inc. cannot act on any complaint without proper and conclusive
proof of abusive activity.

ANY USER WHO DOES NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS
SHOULD IMMEDIATELY STOP USE OF THE PRODUCTS AND NOTIFY TRIBAL VOICE,
INC. IMMEDIATELY SO THAT THEIR ACCOUNT MAY BE TERMINATED.
