<p>ALL USE OF POWWOW CLIENT SOFTWARE IS SUBJECT TO THIS LICENSE<br />
AGREEMENT.  BY CLICKING ON THE &#8220;YES&#8221; BUTTON BELOW, YOU ARE<br />
AGREEING TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS<br />
AGREEMENT, AND YOU CONSENT TO BE BOUND BY AND BECOME A PARTY<br />
TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL THE TERMS AND<br />
CONDITIONS OF THIS AGREEMENT, CLICK THE &#8220;NO&#8221; BUTTON AND YOU<br />
WILL NOT HAVE ANY LICENSE TO AND MAY NOT USE ANY PART OF THE<br />
POWWOW SOFTWARE.  TRIBAL VOICE&#8217;S ACCEPTANCE IS EXPRESSLY<br />
CONDITIONED UPON YOUR ASSENT TO ALL THE TERMS AND CONDITIONS<br />
OF THIS AGREEMENT; IF THESE TERMS ARE CONSIDERED AN OFFER BY<br />
TRIBAL VOICE, ACCEPTANCE IS EXPRESSLY LIMITED TO THESE TERMS.<br />
THE TRIBAL VOICE POWWOW ACCEPTABLE-USE POLICY TERMS AND<br />

<p>PowWow copyright (C) 1995-2000 by Tribal Voice, Inc.  All<br />
rights reserved.  PowWow is distributed free-of-charge for<br />
personal non-institutional use by individuals.  Tribal Voice,<br />
Inc. reserves the right to charge for all other uses.<br />

<p>GRANT</p>
<p>By using the PowWow Software (&#8220;PowWow&#8221;), you agree to<br />
abide by the terms of this license agreement (&#8220;Agreement&#8221;).<br />
Subject to the terms of this Agreement, Tribal Voice, Inc.<br />
(&#8220;Tribal Voice&#8221;) hereby grants you a limited, personal,<br />
nontransferable, nonsublicensable, royalty-free, nonexclusive<br />
license to use one copy of PowWow in object code form only on a<br />
single computer and only in accordance with the applicable end<br />
user and technical documentation for the purpose of accessing<br />
the Tribal Voice Registration Services in order to interact<br />
with other PowWow users via the Internet.</p>

and law enforcement agencies in reporting and investigating any<br />
illicit activities.</p>
<p>We have established the following Terms and Conditions for use.  Please<br />
read them carefully.</p>
<p>By using this software and services you agree to abide by the Terms and<br />
Conditions.</p>
<p>TERMS AND CONDITIONS.</p>
<p>You agree to use Tribal Voice, Inc.&#8217;s products only for lawful<br />
purposes, in compliance with all applicable laws.  You are prohibited<br />
from using Tribal Voice, Inc.&#8217;s, products to compromise security or<br />
tamper with resources of any computer systems.  You are solely<br />
responsible for any content you transmit through or which make use of<br />
Tribal Voice, Inc.&#8217;s products.</p>
<p>You agree to enter a valid email address, of which you are the owner or<br />
primary user, and a unique password. If you use an address that is not<br />
yours, we will not be able assist you with password problems, reply to<br />
answering machine messages you may leave, and so forth.  In short, we<br />
will not be able to communicate with you.  You are entirely responsible<br />
for any breach of privacy or security resulting from your failure to<br />
maintain the confidentiality of your password.</p>
<p>Tribal Voice also recommends that teenagers take steps to protect their<br />
privacy and safety when using the PowWow service or any other public<br />
forum.  Teenagers are advised not to supply detailed information about<br />
themselves in communications with people they do not know.</p>
<p>Adults are encouraged, but not required, to use their real names, unless<br />
you are using a service which requires or encourages anonymity.  You<br />
may not use a name to intentionally impersonate someone or perform<br />
fraudulent activity.  This includes, but is not limited to, the<br />
substitution of letters or numbers, such as the number &#8220;1&#8243; for the<br />
lower-case letter &#8220;l&#8221; or the number &#8220;0&#8243; for the upper-case letter<br />
&#8220;O,&#8221; and so forth.  Vulgar or sexually explicit names are prohibited.</p>
<p>If Tribal Voice, Inc.&#8217;s products are used by persons other than<br />
yourself on your computer, you are responsible for their actions.</p>
<p>You must behave in a responsible fashion.  You agree not to do<br />
anything that detracts from other persons&#8217; enjoyment of the Software<br />
or services.</p>
<p>Tribal Voice, Inc., its suppliers, licensors, and affiliates reserve<br />
the right to take lawful and reasonable actions against anyone who<br />
violates these Terms and Conditions, including, but not limited to,<br />
modifying or discontinuing your access to Tribal Voice, Inc.&#8217;s<br />
products with or without notice to the User.</p>
<p>Tribal Voice, Inc. may, at its sole discretion, exercise its right to<br />
modify or discontinue use of Tribal Voice, Inc.&#8217;s products, goods, or<br />
services.</p>
<p>Tribal Voice, Inc., does not advocate censorship, but profanity used<br />
for harassment or disruption is not a question of free speech.  Such<br />
behavior is rude, abusive, and in some cases it is illegal.</p>
<p>The purpose of PowWow is the free exchange of ideas.  The unwelcome<br />
use of profanity and sexually-suggestive comments, is prohibited on<br />
PowWow.  Profanity, sexually-suggestive comments knowingly made to<br />
minors, sexual harassment of a child, even verbally, is a serious crime<br />
and subject to prosecution.  Do not send materials that contain viruses,<br />
worms, or any other destructive elements.  Insults, threats, pyramid or<br />
other soliciting schemes, or other unwelcome actions meant to disrupt or<br />
abuse other PowWow users are also prohibited.</p>
<p>Tribal Voice allows users to run their own private Communities.  You<br />
agree to adhere to the rules, regulations, policies, guidelines, and<br />
any other such instructions of any Community you join, regardless of<br />
where such information is posted.  Any and all Communities should be<br />
regarded as privately-owned and administered/moderated as the owner<br />
sees fit.  You agree to follow any instructions given by a Community&#8217;s<br />
Administrator(s) and/or Moderator(s).  Abusive activity within a private<br />
Community must be reported to the Community&#8217;s Owner, Administrator(s),<br />
or Moderator(s).</p>
<p>Tribal Voice, Inc., disclaims any and all responsibility for actions<br />
taken by users of our software and services.  You are solely responsible<br />
for maintaining the security of your computer and network connection.</p>
<p>Questions about the Guidelines should be addressed to policy@tribal.com.<br />
Reports of violations should be addressed to abuse@tribal.com, with the<br />
Connection Information of the abuser, the address of the Community in<br />
which the abuse occurred, and any logs or screen captures.  Tribal<br />
Voice, Inc. cannot act on any complaint without proper and conclusive<br />
proof of abusive activity.</p>
<p>ANY USER WHO DOES NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS<br />
SHOULD IMMEDIATELY STOP USE OF THE PRODUCTS AND NOTIFY TRIBAL VOICE,<br />
INC. IMMEDIATELY SO THAT THEIR ACCOUNT MAY BE TERMINATED.</p>
